YES, GST @ 18% TO BE LEVID ON RENT PAYMENTS.
BUT
only on renting of commercial property NOT on renting of residential property.
OTHER IMPORTANT POINTS TO BE WORTH REMEMBER BEFORE COMING TO CONCLUSION:
1. If residential property is USED FOR RESIDENCE only then GST is EXEMPT.
2.If residential property is used for office/business use/commercial use.,.THEN TAXABLE.
3. No GST IF: Landlord doesnot have any GST registration and total services provided by landlord is less than Rs. 20 lakhs.
4. As per Place of Supply Rules-Place of supply in case of immovable property is LOCATION WHERE PROPERTY IS SITUATED. hence registration of landlord and location of property is i
important factor to determine whether CGST&SGST/ IGST is leviable.
5. TDS POINT-If Rent paid exceed Rs. 180000 in a financial year then TDS is to be deducted by TENANT only if TENANT is liable to Tax Audit under Income Tax Act.
6. If Charitable trust or religious trust own a place and rent on shops or any other spaceis less than Rs. 10,000 per month.,then NO GST.
